Could this affect you? [ USA songwriters to get bashing? ]

 

On Monday, January 28, the Copyright Royalty Board (CRB) begins the hearing that will determine mechanical rates for every songwriter and music publisher in America. It will be the most important rate hearing in the history of the music industry because in addition to setting rates for physical products, rates will be set for the first time ever for digital products such as digital downloads, subscription services and ring-tones.

The National Music Publishers' Association (NMPA) will be representing the interests of songwriters and music publishers and will be fighting vigorously to protect those interests to ensure that musical compositions are compensated fairly.

On the other side of this fight stands the Recording Industry Association of America (RIAA) and the Digital Music Association (DiMA). Both the RIAA and DiMA have proposed significant reductions in mechanical royalty rates that would be disastrous for songwriters and music publishers. This is literally a fight for the survival of our industry.

To give you an example of what is at stake, the current rate for physical phono-records is 9.1 cents. The NMPA is proposing an increase to 12.5 cents per song. The RIAA, however, has proposed slashing the rate to approximately 6 cents a song - a cut of more than one-third the current rate!

For permanent digital downloads, NMPA is proposing a rate of 15 cents per track because the costs involved are much less than for physical products. The RIAA has proposed the outrageous rate of approximately 5 - 5.5 cents per track, and DiMA is proposing even less.

If you find that troubling, it gets worse. For interactive streaming services, which some analysts believe will be the future of the music industry, NMPA is proposing a rate of the greater of 12.5% of revenue, 27.5% of content costs, or a micro-penny calculation based on usage. The RIAA actually proposed that songwriters and music publishers should get the equivalent of .58% of revenue. This isn't a typo - less than 1%. And DiMA is taking the shocking and offensive position that songwriters' and music publishers' mechanical rights should be zero, because DiMA does not believe we have any such rights!

The initial hearing will last four weeks, with the three permanent Copyright Royalty Judges hearing arguments Mondays through Thursdays from 9:30 am - 4:30 p.m. each day. At the conclusion of the initial hearing, there will be more discovery, followed by a rebuttal hearing in May, and a final decision expected on October 2.

The NMPA will be spending millions dollars in this proceeding to protect the interests of songwriters and music publishers against the much larger record labels and digital media companies. And although we face such an enormous fight, we have an incredible advantage - we represent songwriters, without whom the record labels and digital music services could not exist.

Marshall announces Randy Rhoads 1959RR Amp.[ my fave guitar amp company release a new classic amp.] 

  

Marshall has announced the 1959RR Randy Rhoads signature amp.  Jim Marshall has embarked on a marketing strategy of releasing a string of amps which are specific to the artists who played them ... the other companies are following his lead!  This new signature amp is a 'burster'.

 

It's a 100 watter, with a three band EQ, three ECC83 pre-amp valves, four EL43 power amp valves, and cascade mod. Head only and no price or release date at the moment. Looks good hey....

Hi Dec

I'm still reading your courses everyday.  Two songs recorded by a current hit singer and hit producer,
funded by a company in LA, 2007.  
 
Another life-long dream of mine did come true in 2007. 
I've just started a job as a currency trader with a multi-national financial firm in The City.
I have no degree and the last 'proper job' I had before that was selling cigarettes and newspapers in a corner shop!
 
I used all the thinking strategies you gave me, persistence, sales, image and presentation skills.
The person I was interviewed by is the CEO of the firm (the ex-CEO of JP Morgan.) 
 
Before getting your course in 2004 I was the 'broke/angry/confused' type you describe so well.
So a big thank you, everything about my life has changed for the better since.
 
I even have plenty of time to keep working on my music as most days I'm running the account from
a little office in my flat on the Brighton sea-front! (I took your advice and set up my own company
so the bank is technically my 'client').

Subscriber's Section Yet another 'split the royalties' question ]

 

Hi Dec,


I have spent the last 4 years recording the vocals for an album for a friend. He has written and produced the album and I have done all lead and most backing vocals. It is now finished!

 

There was one other musician involved (a bass player) but all other instrumentation was by my friend.

He is now wanting to sell the album and is offering me and the bass player royalties of 7.5% of net profits. I wasn't paid anything at all for all the recording time I spent.

 

I'm not griping but I wanted to make sure I'm not doing myself out of any future income - I'm a single mum and every penny counts! I don't even know if it will sell anything but best to err on the side of caution!

 

Can you let me know if you believe 7.5% is fair and in line with the market rates etc - I can't seem to find any definitive answer on the internet and I can't afford my own music lawyer.

 

Any help would be gratefully received.

You won't find any useful info on the Internet because it is all 'free' ... which in English means 'useless'.  You simply have to pay for information ... and any lawyer will charge around £2,000 -  his advice will be less than useless.

Let me start by saying that this is idiotic!  Would a brain surgeon work for 4 years for nothing?  And I equate pros in our business to brain surgeons.

Before I go on, let me ask you to promise yourself that you will never do this again?  You must have all contracts, PRS, Mechanicals, PPL, VPL signed before the studio lights are switched on.

Instrumentation is programming from what I understand you are saying .......... you are not saying who actually wrote the songs, as in who wrote the melody, lyrics and chord sheet?  That is technically who wrote the songs.

The recording contract [for 'mechanicals' ... the money made from shop and Internet sales] is usually between the principal artist on the record and the recording company.  The percentage would normally be 12-15% depending on how strongly the recording company felt it would make money.

 

Normally the bass player would be treated as a 'session player' and would be paid per session .... he would also pick up independent royalties from PPL [Phonographic Performance Limited] ... this would be his responsibility ... no one else's.  As you would!

 

In real terms, the contract should be between YOU and the record company and your percentage of mechanicals should be 12-15%.

 

The bass player should have had more sense than to provide his services without a contract up front or being paid per session [the proper way].  Then he would pick up the PPL and VPL royalties.

 

I feel that the maker of these recordings has not much savvy [or maybe is extremely clever and taking advantage of your lack of knowledge].  He is probably attempting to sell the recordings and not paying out anything up front.  You see, in normal circumstances, YOU should be paid an advance plus the percentage ... the amount of advance will always influence the size of the percentage.

 

C***** .... you are not the only one caught like  this ... my own daughter would not listen to 'Daddy' and ended up wasting 12 years on 'no hope' projects.
